Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, programs, content, and services (collectively, the "Services") offered by The Upward Momentum Blueprint ("we", "us", or "our"). By creating an account, enrolling in a program, or otherwise using the Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements.
2. Your account
You are responsible for keeping your login credentials confidential and for everything that happens under your account. Notify us promptly of any suspected unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. The program
The Upward Momentum Blueprint is a self-development program. Content, modules, exercises, AI-assisted coaching, and community features are provided for your personal, non-commercial use. We may update, improve, or discontinue features at any time.
4. Payment, tiers, and renewals
Access to paid tiers requires payment of the applicable fees through our payment processor. Fees are listed in the local currency presented at checkout and are non-transferable. Unless stated otherwise, fees are one-time and not subscriptions.
5. Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms.
6. Acceptable use
You agree not to:
- resell, redistribute, or publicly post program materials;
- scrape, reverse engineer, or attempt to disrupt the Services;
- upload unlawful, harassing, or infringing content to the community;
- impersonate another person or misrepresent your affiliation;
- use the Services to develop a competing product or train AI models.
7. User content and community
You retain ownership of content you post to community features. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and use that content to operate and improve the Services. We may remove content that violates these Terms.
8. AI features
The Services include AI-assisted coaching. AI responses are generated automatically, may be inaccurate, and are not a substitute for professional advice. Do not submit confidential information you would not want processed by a third-party AI provider.
9. Intellectual property
All program materials, software, text, graphics, and trademarks are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to access the materials for the duration of your enrollment.
10. Disclaimers
The Services are provided "as is" without warranties of any kind. We do not guarantee any specific income, career, financial, or personal-development outcome. See our Disclaimer for more.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold us harmless from any claims arising out of your use of the Services, your content, or your violation of these Terms.
13. Termination
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive termination will survive.
14. Changes
We may update these Terms from time to time. Material changes will be communicated through the Services or by email. Continued use after changes means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts located in that jurisdiction.
